Trademarks and Copyrights

Indemnity
As a condition of use of Fed Help Medical websites, the User agrees to indemnify Miami-Dade County, Fed Help Medical, their respective commissioners, governing board members, officers, employees and agents, and contractors against any and all liability, expenses (including attorney’s fees) and damages arising out of claims resulting from User’s use of Fed Help Medical websites, including without limitation any claims alleging facts that if true would constitute a breach by User of these terms and conditions.
Jurisdiction
This Agreement is governed by the laws of the State of Florida, USA. The User consents to the exclusive jurisdiction and venue of courts in Miami-Dade County, Florida, USA, in all disputes arising out of or relating to the use of Fed Help Medical websites. Use of Fed Help Medical websites is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
Fed Help Medical’ performance of this Agreement is subject to existing laws and legal process and nothing contained in this Agreement is in derogation of Fed Help Medical’ right to comply with law enforcement requests or requirements relating to the User’s use of Fed Help Medical websites or information provided to or gathered by Fed Help Medical with respect to such use.
Severability
If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitation set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect.
Forms
Fed Help Medical websites contain forms through which Users may request information or supply feedback to Fed Help Medical. In some cases, telephone numbers, e-mail addresses or return addresses are required so that Fed Help Medical can supply requested information to you. After the User fills out a form, Fed Help Medical may contact User with follow-up information (unless an “opt-out” box is checked on the form). Fed Help Medical does not save this personal information for any other reason.
Surveys
Occasionally, Fed Help Medical may survey visitors to its websites. The information from these surveys is used in aggregate form to help Fed Help Medical understand the needs of its visitors so that it can improve its websites. Fed Help Medical generally does not ask for information in surveys that would personally identify the User. If Fed Help Medical does request contact information for follow-up, the User may decline to provide it. E-mail
“Phishing” is a scam designed to steal personal information. If the User receives an e-mail that looks like it is from Fed Help Medical asking for your personal information, the User should not respond. Fed Help Medical will never request the User’s password, username, or other personal information through e-mail.
Username and Password
In the event the User accesses any Fed Help Medical websites requiring a username and password, the User is solely responsible for keeping such Username and password strictly confidential.
Non-Personal Information
Fed Help Medical collects non-personal information such as website usage, traffic patterns, site performance and related statistics based on its tracking of the User’s visits to Fed Help Medical websites.
IP Addresses
Fed Help Medical web servers automatically collect the IP (Internet Protocol) address of the computers that access Fed Help Medical websites. An IP address is a number that is assigned to the User’s computer when the Internet is accessed. It is not truly personally identifiable information because many different individuals can access the Internet via the same computer. Fed Help Medical may use this information in aggregate form to better understand how its websites are being used and how it can better serve its visitors. Although such information is not personally identifiable, Fed Help Medical can determine from an IP address a visitor’s Internet Service Provider and the geographic location of his or her point of connectivity.

Agreement in its Entirety
This Agreement constitutes the entire agreement between the User and Fed Help Medical (and its contractors and agents) with respect to Fed Help Medical websites and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and Fed Help Medical with respect to Fed Help Medical websites. This Agreement shall be deemed to include all other notices, policies, disclaimers and other terms contained in Fed Help Medical websites; provided, however, that in the event of a conflict between such other terms and the terms of this Agreement, the terms of this Agreement shall control. A printed version of this Agreement and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
